1. SUBJECT MATTER

The company SANDRO SCHMID sells the goods to the customer under the following general terms and conditions (GTC).

2. CONCLUSION OF CONTRACT

The contract between the customer and the company SANDRO SCHMID comes about through an order from the customer and its acceptance by the company Suspension Center. The customer's order is placed by telephone, in writing or by fax. SANDRO SCHMID accepts the order by delivering the ordered goods to the customer.

3. PRODUCT OFFERING

All information about the goods that the customer receives as part of the ordering process is non-binding. In particular, we reserve the right to make changes in design, technology and price that improve the functionality of a product, as well as errors in description, illustration and price information.

4. PAYMENT TERMS

All prices are target prices that can be continuously adjusted to the market. They are in Swiss francs (CHF), including VAT, unpackaged, postage paid ex warehouse. Transport and packaging costs will be charged separately. In principle, payment must be made net within 30 days of invoicing. In principle, all amounts can be paid by invoice. In special cases, the company SANDRO SCHMID reserves the right to only deliver cash on delivery or advance payment. In the event of a delay in payment, SANDRO SCHMID is entitled to charge a reminder fee of CHF 10 per reminder as well as interest on arrears. If the open amount has to be claimed by legal means, SANDRO SCHMID is entitled to charge a processing fee of CHF 150 in addition to the official fees.

5. TERMS OF DELIVERY

The ordered products can only be sent to an address in Switzerland and Liechtenstein, but may also be sent to other countries by arrangement. If in stock, the products will be delivered immediately to the address specified by the customer. Otherwise, an order confirmation (by telephone, e-mail, fax or post) with the expected delivery date will be sent. The delivery of the goods takes place (ex warehouse) at the expense and risk of the customer, even if partial deliveries are made. In the event of externally visible damage to the goods ordered, claims will only be settled against a certificate from the respective carrier. If an ordered product is no longer available at the time of delivery, SANDRO SCHMID expressly reserves the right to exchange the product for an equivalent product.

6. RESERVATION OF TITLE

The delivered goods remain the property of SANDRO SCHMID until full payment has been made. If the customer is in arrears with the payment of the purchase price, SANDRO SCHMID is entitled to withdraw from the contract (declaration of withdrawal) and to take possession of the goods.

7. RETURN POLICY

The customer has the right within a period of 10 calendar days to revoke the conclusion of the contract without giving reasons and to return the goods. The delivered goods must be returned undamaged, functional and complete. The right of return begins with the receipt of the goods by the customer. Products specially ordered, manufactured and/or adapted at the customer's request are generally excluded from the right of return. In special cases, SANDRO SCHMID reserves the right to charge for the labor costs for restoring a product to its original condition. If the customer has returned the goods on time and properly, he will receive a credit (refund) from SANDRO SCHMID or, if desired, a replacement delivery. In the event of a return, the collection costs may be charged.

8. WARRANTY AND LIABILITY

The guarantee period for all products offered in the ( online ) catalog is 12 months from the date of purchase, unless a longer guarantee period is expressly stated. Products will be replaced or repaired free of charge provided the customer reports the defect in writing within 10 calendar days of receipt of the goods. The guarantee expires if changes or repairs are made to the goods without the written consent of SANDRO SCHMID. As far as the legal regulations allow, liability for damages is excluded. In particular, the SANDRO SCHMID company is not liable for damage that can be attributed to improper use or natural wear and tear or for damage that did not occur on the delivery item itself (consequential damage).

9. INTELLECTUAL PROPERTY

The SANDRO SCHMID company reserves all rights for every design, every text, every graphic on its website. Copying or any other reproduction of the entire website or parts of this website is only permitted for the purpose of placing an order with SSANDRO SCHMID. All other trademarks, product names or company names or logos cited on this website are the sole property of the respective beneficiaries. SANDRO SCHMID reserves the property rights and copyrights to illustrations, drawings, calculations and other documents. Before passing them on to third parties, the customer requires the express written consent of SANDRO SCHMID.

10. DATA PROTECTION / CREDIT CHECK

The SANDRO SCHMID company assures that it will observe the provisions of the Swiss Data Protection Act and the relevant legal standards when collecting, processing and using personal data. The customer data collected during order processing is only used for internal market research purposes. When paying against invoice, SANDRO SCHMID reserves the right to check the customer's creditworthiness and identity. The data required for business transactions are stored and, if necessary, passed on to affiliated companies as part of order processing. The contract data (surname, first name, street / house number, zip code / city) are used to initiate a credit check in the event of delivery against invoice. All personal data is treated confidentially. The customer agrees to this use of his data. In addition, he has the right to view the data stored about him at any time and to prohibit their use for internal market research purposes.

11. JURISDICTION AND APPLICABLE LAW

These General Terms and Conditions and the contracts concluded on the basis of these General Terms and Conditions are subject to Swiss law. Place of jurisdiction is Chur. In the event of a dispute, SANDRO SCHMID reserves the right to prosecute the other party at their place of residence or place of business.

12. FINAL PROVISIONS

When selling the goods specified by the company SANDRO SCHMID, the General Terms and Conditions apply exclusively in the version valid at the time the respective contract was concluded. These terms and conditions also apply in particular if they differ from those of the customer. Should individual provisions of these General Terms and Conditions be or become ineffective, this shall not affect the legal validity of the remaining provisions. Furthermore, Suspension Center reserves the right to amend these General Terms and Conditions at any time.
